September 28, 2009-Senator Evan Bayh of Indiana, a leading moderate Democrat, thinks time is running out for the most ambitious item on the agenda of labor unions -- the so-called "card check" legislation. The bill has been moving with glacial speed through Congress this year. One reason is that previous supporters such as Senator Bayh are having second thoughts.

Mr. Bayh has been inundated with billboards and radio ads back home sponsored by a pro-business group called DoNotLetEvanBayhKillJobs.com. The name may be clunky, but the message appears to be getting through. Senator Bayh told the Howey Political Report over the weekend that the major provisions of card check are in trouble. He said he now supports the preservation of secret ballot elections and added: "I don't think we're going to have binding arbitration. . . I don't think we're even going to vote on [card check] this year."

Mr. Bayh's opinion counts because Democrats need 60 votes to break a filibuster in the Senate. They now hold 60 votes, but with Republicans apparently universally opposed to card check, President Obama and Majority Leader Harry Reid can't afford to lose even a single senator. As it looks right now, Indiana employers are winning the battle against local labor unions in getting Mr. Bayh's attention.
